TERMS & CONDITIONS

1.  Acceptance of Terms
 
By accessing the Site, booking an appointment, completing a purchase, or clicking “I Agree” (or similar), you (“Client,” “you”) accept these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Site or Services.
 
 
2.  Services & Medical Disclaimer
 
Empire provides cosmetic and aesthetic treatments performed by licensed medical professionals or certified technicians under medical supervision. Nothing on this Site constitutes medical advice. Consult a qualified healthcare provider regarding any medical condition. Results vary by individual; we make no guarantee of outcome.
 
 
3.  Eligibility
 
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to consent to treatment. By booking, you represent that all information you provide is truthful and complete.
 
 
4.  Booking, Cancellations & No-Shows
 

  • Bookings may be made online, by phone, or in person.

  • A credit card hold or deposit may be required.

  • Cancellations or rescheduling must be made at least 24 hours before the appointment; otherwise, we may charge a late-cancel/no-show fee up to 100 % of the service price.

  • Arriving more than 10 minutes late may shorten or forfeit your session.

 
 
5.  Fees & Payments
 
Prices are listed in U.S. dollars and are subject to change without notice. We accept major credit cards, debit cards, FSA/HSA where eligible, and financing plans (subject to approval). Full payment is due at time of service unless otherwise agreed.
 
 
6.  Gift Cards & Packages
 
Gift cards and pre-paid packages are non-refundable and expire five (5) years from purchase unless a shorter period is mandated by law. They are transferable but have no cash value.
 
 
7.  Content & Intellectual Property
 
All Site content—including text, graphics, logos, images, videos, software, and trademarks—is owned by or licensed to Empire and protected by U.S. and international intellectual-property laws. You may use the Site only for personal, non-commercial purposes.
 
 
8.  User-Generated Content
 
If you submit reviews, comments, photos, or other materials (“User Content”), you grant Empire a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such content in any media. You represent that you own or control all rights in your User Content.
 
 
9.  Prohibited Conduct
 
You agree not to:
 

  • Violate any applicable law or regulation;

  • Infringe intellectual-property or privacy rights;

  • Upload malicious code or interfere with Site security;

  • Harass, threaten, or defraud Empire staff or clients;

  • Use automated means (bots, scraping) without permission.

 
 
10.  Third-Party Services & LeadAR Messaging
 
The Site may contain links to third-party sites or integrate with lead-management tools such as LeadAR. We are not responsible for third-party content or practices. By opting in to SMS/email communications, you consent to receive automated marketing messages; message and data rates may apply; reply “STOP” to cancel.
 
 
11.  Privacy & HIPAA
 
Our collection and use of Personal Information and PHI are governed by our Privacy Policy and HIPAA Notice of Privacy Practices (provided in-clinic). In case of conflict, HIPAA controls.
 
 
12.  Disclaimer of Warranties
 
The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
 
 
13.  Limitation of Liability
 
To the maximum extent permitted by law, Empire, its owners, employees, providers, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, arising out of or related to the Site or Services, even if advised of the possibility. Our total liability shall not exceed the amount you paid for the relevant Service giving rise to the claim.
 
 
14.  Indemnification
 
You agree to indemnify, defend, and hold harmless Empire and its affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your breach of these Terms, your negligence or willful misconduct, or your violation of any law or the rights of a third party.
 
 
15.  Governing Law & Venue
 
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Ohio County, West Virginia, and the parties consent to personal jurisdiction there.
 
 
16.  Dispute Resolution & Arbitration (Optional)
 
Alternative Clause (replace if preferred): Any dispute arising out of or relating to these Terms or the Services shall be finally resolved by confidential, binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, held in Wheeling, WV. Judgment on the award may be entered in any court of competent jurisdiction. YOU WAIVE THE RIGHT TO A JURY TRIAL.
 
 
17.  Changes to Terms
 
We may modify these Terms at any time. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
 
 
18.  Severability
 
If any provision is deemed unenforceable, the remaining provisions will remain in full force and effect.
 
 
19.  Entire Agreement
 
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Empire regarding the Site and Services and supersede all prior communications.
